Terms & Conditions Unless otherwise agreed in writing by METAZA LIMITED these conditions shall override any conditions relating to the customers order or negotiations.

Title The title to goods shall not pass to the customer until payment of the invoice price, in the case of non payment, the company shall be entitled to repossess or trace the goods or the proceeds of sale in the customers hands or the hands of any liquidator or receiver. The risk in goods shall pass to the customer on delivery. Metaza Ltd are a wholesale company, operating in a business to business environment, we do not deal direct to the consumer therefor typical consumer regulations do not apply.

Specification Sizes and capacities should be taken as approximate only. METAZA LIMITED reserve the right to vary the specification without prior notice.

|
Value Added Tax METAZA LIMITED shall be entitled to charge any VAT payable whether or not shown on quotation or invoice at the applicable rate.

|
Tooling & Drawings Any required tooling or drawing for the execution of work undertaken by METAZA LIMITED should be paid for by the customer, but remain the property of METAZA LIMITED. |

Customers Materials Customers property when supplied, will be held entirely at the customer’s risk as regards fire, theft and other unforeseen damage. Every care will be taken to obtain the best results where materials are supplied by customers, but responsibility will not be accepted for imperfect work caused by defects in or unsuitability of materials so supplied.

Restocking Goods returned unwanted and in perfect condition will be subject to a 25% restocking charge. Returned goods damaged in transit cannot be credited. METAZA LIMITED cannot accept the return of specifically branded goods.

|
Carriage All prices are quoted ex-works. Carriage will be paid for by the customer unless otherwise agreed in writing. Claims arising from damage to or partial loss of goods in transit must be made in writing to METAZA LIMITED and the carrier, so as to reach them within 7 days of delivery. Claims for non delivery should be made within 14 days of dispatch of the goods. Where free delivery is provided it is done so as CIF (cost, insurance & freight) and any customs charges are the responsibility of the receiver. Failure to accept a delivery due to import charges will result in our restocking fee being applied.

Liability METAZA LIMITED shall NOT be liable for indirect or consequential loss or any loss to the customer arising from third party claims occasioned by errors in carrying out the work or by delays in delivery. Where work is defective including negligence, METAZA LIMITED’s liability shall be limited to rectifying such defects.

Terms 30 days from date of invoice for approved accounts only. Terms for all other customers will be strictly against pro-forma unless otherwise stated in writing. A surcharge of 1.5% per week will be levied on all balances remaining unpaid after due date.

Cost Variation The prices are subject to revision in the event of any variation in the cost incurred by METAZA LIMITED, between the date of the receipt of the order and the date of delivery to the buyer. All prices are GBP and any foreign currency conversion is an approximate guide only, as the actual exchange rate for the transaction is decided by the customers bank or credit card provider.

Materials The contract is not a contract by sale by sample, although every endeavor will be made to supply materials in accordance with the quality of the sample submitted or quoted for.

Force Majeure
Every effort will be made to carry out an accepted order which, however, is subject to cancellation by METAZA LIMITED or to set variations as the company may find necessary as a result of inability to secure labour, materials, or supplied as a result of any act of God, war, strike, lock-out, or other labour dispute, fire, flood, drought, legislation or other cause (whether of the foregoing class or not) beyond METAZA LIMITED’s controls.
Goods remain the property of METAZA LIMITED until paid for in full and may be repossessed without notice in the event of non-payment.

Shipping & Handling For orders shipped outside the UK, the Seller cannot be held responsible should local custom authorities confiscate any shipment (or part thereof), delay shipment or charge import duty or other levies. Prices quoted are exclusive of VAT and any other taxes, levies, duty, import duty or any other similar charges whatsoever, all of which are the total responsibility of the Buyer and liable for payment in full by the Buyer. All prices are quoted ex-works. Carriage will be paid for by the Buyer unless otherwise agreed in writing. The Seller shall be entitled to charge any VAT payable whether or not shown on quotation or invoice at the applicable rate.
